Chapter I
GENERAL PROVISIONS
Purpose and Function of the House Rules
§ (1) The purpose of these House Rules is to define the rights and obligations of persons staying at Cutler Fitness by Allure, Eger (3300 Eger, Liliom u. 1., hereinafter: Cutler Gym), as well as those using the services of Cutler Gym (hereinafter: service users), and other individuals present on the premises (hereinafter collectively referred to as: other persons). The rules also aim to regulate their mutual behavior and establish the fundamental rules that ensure the high-quality and safe provision and use of the services of Cutler Gym.
(2) Additionally, these House Rules lay down regulations for the proper use of services, preservation of equipment and facilities, and safe operation.
(3) Cutler Gym reserves the right to unilaterally amend the House Rules at any time. Such changes will be published on the website (www.allure-eger.hu) and within the gym premises.
Personal and Territorial Scope of the House Rules
2. § (1) These House Rules apply to everyone who is on the premises of Cutler Gym either for using the services or for any other reason (service users and other persons).
(2) The territorial scope includes the entire area used by Cutler Gym.
Guests and visitors acknowledge these House Rules as binding upon purchasing any day or monthly Club membership or any other document granting access.
(3) Purchasing a daily or monthly Club membership or using any service or facility of Cutler Gym implies the explicit acceptance and acknowledgment of these House Rules.
§ The House Rules are available at the reception of Cutler Gym and on the gym's website (www.allure-eger.hu).
Opening Hours of Cutler Gym
4. § (1) The opening hours of Cutler Gym are as follows:
Monday - Friday: 06:00 - 23:00
Saturday - Sunday: 08:00 - 23:00
(2) Cutler Gym reserves the right to change its opening hours and prices.
General Provisions Regarding the Use of Services
5. § The following services are available on the premises:
Bodybuilding and fitness training area, exercise, and physical wellness services.
Beverage and food-related retail services.
§ (1) Cutler Gym services can only be used with a valid daily or monthly Club membership or via a contract or agreement concluded with a third party.
(2) Any entry cards, memberships, or documents issued by the gym are the property of the service user.
(3) The validity of the above documents will be checked upon each entry. All guests must present their entry authorization and may be asked to sign if necessary. Refusal or bypassing this process may result in being denied access without further explanation.
(4) A daily Club membership entitles the holder to one-time entry and use of the gym.
(5) Monthly members may enter the gym and use its services multiple times daily. Timeframes must be interpreted in line with Section 7.
§ Monthly terms are defined as 28 calendar days per month.
§ (1) Monthly Club memberships are non-transferable and may not be used by anyone other than the registered holder.
(2) Separate locker rooms and lockers are provided for changing clothes based on gender. The use of lockers is mandatory and only allowed during the workout. Slippers are required in locker and shower areas. Liability for items stored in lockers is governed by the Liability Regulations.
(3) Daily members must return their entry card to the reception upon departure. In case of loss, a fee of HUF 1,000 must be paid.
(4) Monthly Club membership cards and wristbands are not included in the membership fee. Card fee: HUF 1,500. Replacement in case of loss: HUF 1,500. Wristband fee: HUF 3,000. Replacement: HUF 3,000.
(5) Towels are available at the reception for a fee. Lost towels incur a charge of HUF 4,000.
(6) Lost items must be handed in at reception. Items will be stored for one month before disposal.
§ Cutler Gym reserves the right to refuse entry.
Chapter II
SPECIAL PROVISIONS
Specific Provisions Regarding Use of Equipment and Services
§ (1) Services of Cutler Gym may only be used in appropriate physical, mental, and psychological condition.
(2) While using the services, users must maintain hygiene and cleanliness. Only beverages in sealed plastic bottles are allowed.
(3) Services may only be used while wearing clean sports attire and closed training shoes. Visitors must wear clean and safe gym-appropriate clothing.
(4) It is prohibited to place dumbbells, weights, or personal items on leather-covered machines.
(5) Disturbing others while working out is strictly forbidden.
(6) Supporting equipment like thermostats, air conditioners, etc., must not be used or adjusted by guests. Requests should be directed to reception.
(7) Fixtures in wet areas must be used properly. Do not dispose of garbage, pads, cloths, or hazardous materials in toilets or drains.
(8) Children under 14 may only use the gym services under the supervision of a parent and personal trainer.
Regulations Regarding Items and Materials Brought Into Cutler Gym
§ The following activities and items are prohibited on the premises:
Smoking, alcohol, drugs, doping substances,
Any hazardous material or item (firearms, ammunition, explosives, fireworks),
Live animals, food, beverages (except those sold by Cutler Gym),
Any activity outside the gym’s scope or illegal, immoral, criminal, or offensive conduct,
Any commercial activity, advertising, marketing, media recording, or gambling without the gym’s permission.
§ Only products sold by the gym may be consumed on the premises. Food and drink consumption is allowed only in designated areas.
§ (1) The following may only be installed with prior permission:
Food vendors or machines,
Game machines or public electronics,
Advertisements and marketing materials.
(2) Any damage caused by the unauthorized placement of the above is to be reimbursed by the responsible party.
(3) Cutler Gym does not promote or advertise trainers conducting professional activities on the premises.
Professional Support for Use of Services
§ (1) Only qualified professionals authorized by Cutler Gym may provide coaching or training.
(2) Service users may only seek training advice from these approved individuals.
(3) Cutler Gym assumes no responsibility for injury or damage from unofficial advice.
(4) Cutler Gym disclaims all liability related to the conduct of individual trainers.
(5) Further rules are governed by individual contracts with trainers.
(6) Related qualifications are listed in Government Regulation 157/2004. (V.18.).
Chapter III
LIABILITY AND DAMAGES
§ (1) Equipment at Cutler Gym may only be used as intended. Services must also be used properly.
(2) Only information provided by gym staff or contracted, qualified personal trainers may be accepted. Cutler Gym accepts no liability for advice given by other visitors.
(3) Cutler Gym is not liable for personal or property damage resulting from improper use of services or equipment, or violation of laws or house rules, or due to negligence of the service user. In such cases, the responsible party is liable for compensation.
(4) Everyone uses the gym at their own risk.
(5) Persons under the influence of alcohol, drugs, or suffering from infectious diseases may not enter the premises. Pregnant women may only use the gym at their own risk.
§ (1) Any extraordinary events, equipment malfunctions, or rule violations must be reported immediately to the reception. Failure to do so may result in liability for damages.
(2) Lockers and safes are available free of charge for storing personal items directly related to gym use.
(3) Cutler Gym is not liable for the loss of valuables or cash due to improper use of lockers or safes, or for bringing items not typically needed in a gym.
(4) Locker and safe keys must be kept secure. Cutler Gym is not responsible for items left unattended outside lockers or safes.
(5) Visitors are responsible for any damage they cause and must reimburse Cutler Gym accordingly.
Chapter V
DATA PROTECTION
§ (1) The Operator, Allure Hotel Korlátolt Felelősségű Társaság (registered office: 2151 Fót, Titok köz 1. B. ép., company registration number: 01-09-990789, tax number: 24107754-2-41, hereinafter: Data Controller), processes the personal data and images provided by guests during registration in accordance with the provisions of Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information – until the receipt of an objection or, if the guest has given explicit consent, for a further specified period – without further consideration or permission, for its own marketing and direct business acquisition purposes.
(2) Upon receipt of a request for deletion, the Data Controller will delete the personal data from its records within 30 days. The Data Controller provides information about the data processing at any time upon request.
(3) The guest has the right to object to the processing of their personal data. If they disagree with the decision of the Data Controller based on the objection, they may turn to a court or the Hungarian National Authority for Data Protection and Freedom of Information (NAIH). The data processing has been reported to the Authority, and the registration number is in progress.
(4) Additional information security and data protection rules are contained in the Privacy Policy of Cutler Gym.
Rules Regarding Image and Sound Recording
§ (1) A camera system operates in all rooms of Cutler Gym for security and property protection purposes.
(2) Visitors of Cutler Gym expressly acknowledge that video recordings may be made of them when using the services, and Cutler Gym will manage, store, and use such recordings in accordance with the applicable legal regulations.
(3) By accepting the House Rules and using the services, users and other persons expressly consent to the use of image recordings – particularly videos and photographs – made to present or promote the activities and services of Cutler Gym, even if they appear in such recordings. Cutler Gym commits to using the images solely for the above purpose, except in case of mandatory data provision to authorities.
(4) Accordingly, users and other individuals cannot assert any claims against Cutler Gym related to such images, including but not limited to prohibiting publication or distribution, requesting anonymization, or demanding any fee or financial compensation.
Chapter VI
FINAL PROVISIONS
§ These House Rules enter into force on February 1, 2021.
